GENERAL TERMS AND CONDITIONS
1. SCOPE AND SUBJECT MATTER OF THE GENERAL TERMS AND CONDITIONS OF BUSINESS
These include all activities of Ipsum-Coaching | Antje Rüllenrath (hereinafter referred to as Service Provider/Organizer), and product such as individual coaching, group coaching, systemic constellations, workshops, trainings, retreats, community events, etc. and/or unnamed contract conclusions, which are related to said business activities.
The service provider mainly offers services in the field of trauma sensitive coaching, EMDR, yoga, reiki, trance and meditation. The present General Terms and Conditions (GTC) are applicable to the purchase of any services of the Participants, which are obtained in any way (by telephone, e-mail, Internet, mobile, etc.) from the Service Provider. A subscriber is any natural or legal person who uses services provided by the service provider or who has registered with the service provider to receive such services. By using one or more services, the participant irrevocably agrees to the application of these GTC.
Likewise, our GTCs apply in full and in addition/differently for courses abroad or holidays/retreats.
2 GENERAL
2.1 For all coaching, EMDR sessions, yoga, reiki and meditation courses, workshops, trainings, private lessons, as well as other events, including transformational yoga retreats, the following terms and conditions apply. At the latest with the binding registration, these terms and conditions are considered legally binding and accepted by the course participant.
2.2 Amendments to these General Terms and Conditions are fundamentally excluded and, in the case of deviating special agreements, shall only be effective if they have been agreed in writing.
Any such agreed changes to the Terms and Conditions shall only apply to the respective legal transaction, expressly not to subsequent transactions or new registrations after the end of a Coaching, Work-shops, Individual Lessons or the respective event. (Comprehensive described in Pt. 2.1, General)
3. SCOPE OF SERVICES
The services include the implementation and organization of coaching and EMDR sessions and retreats, Yoga/Reiki, Systemic Constellations and retreats, individual and group classes, trainings, workshops in Germany and abroad. The individual services will be confirmed individually in writing (Bu-chungs-Tool: individual appointments, longer-term orders: in writing).
4. COSTS, PRICES AND TERMS OF PAYMENT
4.1 The current costs and terms of payment can be found at www.ipsum-coaching.com, on brochures, flyers and in the online booking tool or will be sent in writing upon request.
4.2 Registrations for all offers, (except package, see point 4.3) are legally binding with de-ren deposits by e-mail, SMS, mail or reservation payment. Registrations by telephone will be confirmed by e-mail, upon receipt of the confirmation e-mail from the participant, these registrations are also legally binding and can be invoiced. After we have received the registration, we will send the participant a reservation confirmation e-mail including an invoice for the payment of the course. The payment date listed there is binding. Non-payment of the course fee is not considered a cancellation.
4.3 If the appointment is made via the online booking tool, payment will be made immediately there (stored in the system), unless a subscription is available. If a package is available, the booked appointment will be deducted from the subscription. The personal coaching sessions are invoiced monthly and are to be paid within 14 days after receipt of the invoice.
5. CONDITIONS AND CANCELLATION POLICY (REFUND)
5.1 Coaching sessions and EMDR sessions, paid course fees for packages are non-refundable.
5.2 Workshops or trainings
If a participant is unable to attend a workshop/retreat, he/she always has the option to find a replacement. This must be done in writing by e-mail, stating the name/first name and e-mail address of the substitute person.
The cancellation or refund of the course fee is regulated as follows:

up to 2 months before the start of the event: 25% of the course fee
up to 15 days before the start of the event: 50% of the course fee
less than 15 days before the start of the event: 100% of the course fee
Lessons/sessions/workshops not attended cannot be made up and will not be refunded. In case of absence (illness, professional workload, other reasons) or if the workshop/retreat or training is cancelled, there is no right to any reduction or refund.
5.3 Private lessons (Yoga/Reiki/Meditation/EMDR/etc.)
Cancellations will only be accepted if the corresponding information is received by phone, email or SMS at least 24 hours before the session starts.
5.4 Ipsum-Coaching reserves the right to cancel sessions in case of illness or unforeseeable circumstances - even at short notice - or to be represented by a suitably qualified person. Participants will be informed as soon as possible by email or SMS about a cancellation with the exception of unforeseeable cancellations.
5.5 In order to be able to conduct our workshops/training/events under optimal conditions, we set a minimum and a maximum number of participants depending on the event/course. In case of insufficient number of participants, the course will usually not be held and the course costs will be refunded.
6. ABILITY TO PARTICIPATE, PERSONAL RESPONSIBILITY, CONFIDENTIALITY
6.1 Obligation of the client to participate (coachee/client)
Coaching takes place on the basis of the preparatory discussions held between the parties. It is based on cooperation and mutual trust. Ipsum-Coaching points out that coaching is a free, active and self-responsible process and that certain successes cannot be guaranteed. The coach assists the client as a process facilitator and supporter in decisions and changes - the actual change work is done by the client. The client should therefore be willing and open to deal with himself and his situation. Analogously, the prerequisite for the client applies to consulting, services and training and coaching work.
6.2 Limitations
Existing mental or physical health restrictions are to be reported to Ipsum-Coaching at the latest at the beginning of the course/workshop/event/session. Should a health restriction occur in the course of the course/event/workshop, Ipsum-Coaching must be informed immediately.
Each participant takes part in these courses/coaching sessions on his/her own responsibility, so it is also at the discretion of the respective participant to seek medical advice before participating in the coaching sessions/courses/events/workshops. Should a participant have doubts about his/her health or mental fitness to participate, it is recommended that he/she seek appropriate professional advice before registering.
6.3 Confidentiality
Ipsum-Coaching commits itself to maintain unlimited confidentiality towards third parties about all operational, business and private matters of the client that become known in the course of the activity, even after the termination of the contract. Ipsum-Coaching is subject to the duty of confidentiality, but reserves the right to lift the duty of confidentiality if a risk of personal injury or injury to third parties becomes apparent. In this case, Ipsum-Coaching will contact a professional body.
7. LIABILITY
7.1 The organizer Ipsum-Coaching as well as the teachers assume liability for the proper execution of the courses/events/workshops within the scope of the legal warranty regulations. Any liability beyond this, especially under the title of compensation for damages, is expressly excluded. The organizers therefore assume no liability whatsoever, in particular no liability in the event of concealment of any physical or mental ailments that make participation in the events/sessions/workshops inadvisable. Ipsum-Coaching reserves the right to refuse participants if Ipsum-Coaching is of the opinion that the health or psychological requirements for participation in the course/coaching session are not met. This refusal can also be made at short notice or even during ongoing courses/retreats/sessions. In the event of the participant's rejection, the course fee will be refunded to the participant (on a pro-rata basis).
7.2 The use of the course rooms and offers is at the participants' own risk. No liability will be assumed for valuables brought by participants.
7.3 For all sessions, courses, trainings, events and holidays/retreats organized by Ipsum-Coaching we exclude any liability for damages incurred. You are therefore responsible for sufficient insurance coverage. Ipsum-Coaching cannot be held liable for theft or loss of items.
8. COACHING VACATIONS / TRANSFORMATION RETREATS
8.1 Registration and booking
Registration is done via e-mail, SMS or contact form. After the registration has been received, we will send the participant an email confirmation with the bank details for the payment of the holidays/retreats/training. The payment date listed there is binding. The registration is binding and obligates to pay for the service. Failure to pay the money is not considered a cancellation. If the number of participants is limited, registrations will be considered in the order in which they are received. The receipt of the bank transfer is valid.
8.2 Terms of payment/payment/residual payment
A reservation confirmation will be sent upon registration. The payment conditions on this confirmation are binding. If the payment is not made in time, Ipsum-Coaching can refuse the travel services and claim the cancellation costs.
8.3 Cancellation conditions/cancellation costs
In case of cancellation the following cancellation fees will be charged: up to 60 days before departure 15% of the retreat price for retreats abroad. In case of cancellation at a later date, a refund of the total costs is excluded. The participant has the possibility to name a substitute participant. This must be done at the same time as the cancellation. A handling fee of CHF 100.- will be charged as well as any rebooking costs.
8.4 Program changes
The program as well as changes of individual services (accommodation, tour guide, teachers, means of transport) due to unforeseeable circumstances or safety reasons are expressly reserved and are hereby accepted by the client. In this case, any additional costs will be borne by the participant. Ipsum-Coaching will make every effort to offer equivalent substitute services.
8.5 Entry formalities
Passport or identity card must be valid at least until the return date. Citizens of other countries are advised to check with the consulate or embassy of the country of entry for entry formalities. We recommend that you ensure that your passport is valid for at least 6 months beyond the return date. Compliance with entry requirements is the responsibility of the customer. Please note that Ipsum-Coaching will not assume any liability for non-compliance with regulations and the associated expenses, e.g. in case of denied entry. Please inform yourself independently about changes in regulations until your departure.
8.6 Price changes/adjustments
In exceptional cases, the agreed price may have to be increased. Price increases can result from the following reasons:
- government decreed price increases (e.g. value added tax)
- exchange rate changes
If Ipsum-Coaching has to change the prices for the mentioned reasons, you will be informed about this price increase at the latest 3 weeks before departure. If the price increase is more than 10 percent, you have the right to withdraw from the contract free of charge within 5 days after receiving this notification.
8.7 Trip cancellation by Ipsum-Coaching
Ipsum-Coaching reserves the right to cancel a trip at short notice due to force majeure, official measures or strikes. Likewise, a trip can be cancelled up to 30 days prior to departure if the minimum number of participants is not reached. In this case, the paid travel price will be refunded in full. Further claims cannot be asserted.
8.8 Early termination of the trip by the participant
If the participant has to cancel the trip prematurely for any reason, the price of the travel arrangement will not be refunded. The travel or course management will assist as much as possible in organizing the early return. Any additional costs will be borne by the participant.
8.9 Liability
The liability of Ipsum-Coaching is in any case limited to the amount and scope of the agreed offer and only covers direct damages. Ipsum-Coaching will compensate you for the loss of agreed services if it was not possible to provide an equivalent substitute service on the spot. Ipsum-Coaching is not liable if the non-fulfillment or improper fulfillment of the contract is due to the following causes:
- to omission of the participants before or during the trip
- to unforeseeable or unavoidable failures of a third party not involved in the provision of the contracted service.
- to force majeure or to an event that Ipsum-Coaching, the agent or the service provider could not foresee or avert despite due diligence.
8.10 Personal and health requirements
Good health and a stable mental condition are required for the trips. The participant participates on his own responsibility and is obliged to inform the course management about possible physical and/or mental impairments. If necessary, he/she will seek the advice of an appropriate doctor or psychotherapist before participating. If a participant does not meet the physical or psychological requirements, the tour guide can exclude the participant from the (further) trip. Return travel costs etc. are to be borne by the participant and the paid travel price cannot be refunded.
8.11 Travel insurance
Insurance is the responsibility of the participant in all respects. We advise each participant to take out the following insurances: travel cancellation insurance, health and accident insurance.
8.12 General Insurance Conditions
For all sessions, courses, events, trainings, workshops and holidays/retreats organized by Ipsum-Coaching, we exclude any liability for damages incurred. You are therefore responsible for having sufficient insurance coverage. Ipsum-Coaching cannot be held liable for theft or loss of items. In any case, it is the responsibility of the participants in their country of domicile to have sufficient health/accident insurance with coverage at home and abroad.
8.13 Program and price changes
Program and price changes as well as changes in the general terms and conditions are reserved.
9. PLACE OF PERFORMANCE, PLACE OF JURISDICTION, APPLICABLE LAW
9.1 The place of performance of all obligations is agreed to be the registered office of Ipsum-Coaching. The place of fulfillment is therefore 8280 Kreuzlingen.
9.2 Swiss law applies; for any disputes, a cantonal arbitration board will be consulted in a first instance. In the event of any further disputes which cannot be settled by the arbitration board, the exclusive jurisdiction of the respective court in Kreuzlingen within the scope of its respective value jurisdiction shall be agreed.
9.3 Should individual partial provisions of these General Terms and Conditions of Business as well as any individual contracts to be concluded be or become void, ineffective or contestable, the remaining (partial) provisions shall remain unaffected and shall then be interpreted or supplemented in such a way that the intended economic purpose is achieved as accurately as possible in legal terms.
9.4 Verbal collateral agreements shall not be made. Changes and additions to these GTC's and all membership contracts must be made in writing.
10. DATA PROTECTION
Ipsum-Coaching commits itself to treat the personal data and information confidentially and not to pass them on to third parties. Excluded from this is the passing on of data to employees and business partners for organizational reasons. Likewise, the participant agrees to treat information about other course participants confidentially.
11. MISCELLANEOUS/MISCELLANEOUS
Ipsum-Coaching uses photos of events on its own website or on Facebook where participants can be recognized. Should this happen against the will of a person, he/she can request Ipsum-Coaching to remove his/her person on the picture. Further and own claims can not be asserted.
